The following Terms of Use apply to your use of the LifeCurve Pro™ website and to any other correspondence that you may post to the LifeCurve Pro™ website or send via email in response to a request for information on the Site.
If you continue to browse and use this Website, you are agreeing to comply with and be bound by the following Terms of Use, which together with our Privacy Notice govern ADL Smartcare Limited's relationship with you. If you disagree with any part of these Terms of Use, please do not use our Website.
The use of this website is subject to the following Terms of Use:
Data: Information which can be used to identify a specific individual person.
Processing: any action involving personal data – including working with the data in some way as well as collecting, storing, sharing and deleting the data.
Controller: the person or organisation who determines what data is to be processed, and the purpose for which it is processed.
For the purposes of this notice, ADL Smartcare and Independent Living Assessment jointly hold this role.
"You" or "Your" means the licence holder using the LifeCurve™ Pro (Australia) platform.
"Us", "We" or "Our" refers to ADL Smartcare: Owner of the LifeCurve™ Software, including the knowledge and code it contains.

The LifeCurve™ Pro platform can be utilised by LiveUp Staff to perform LifeCurve™ assessments with service users, retrieve previous assessments, view service user activity and manage orders relating to stores equipment.
As a Staff Member, you must hold an authorised account in order to be able to access the platform. We require some personal information from you in order to manage your account. Without this personal information, you may not be able to access the platform.
ADL Smartcare and iLA are equally committed to protecting your rights and privacy in respect of your personal data, in accordance with the Privacy Legislation Amendment (Enforcement and Other Measures) Bill 2022 (Cth), including the Australian Privacy Principles (APPs).
Independent Living Assessment, will provide us with your name and email address through the secure LifeCurve™ platform, when a licence is requested for you.
When we have collected your data, we will use it to create a licence for you. You will then receive an email notifying you of this and to log in after accepting the Website Terms of Use and this Privacy Notice.
Your data will be stored in Australia on dedicated and segregated secure cloud-based infrastructure. Your data will be retained for six years after ADL Smartcare stop working with iLA.
To aid the management and administration of the platform, from time to time it is necessary for specific employees within ADL Smartcare to have brief access to your data. ADL Smartcare is based in the UK, and so your data will be securely disclosed to the UK if required for this purpose.
Where this does happen, your data will also be protected by, and handled in accordance with, the UK"s Data Protection Act (2018). This includes an expectation that our employees will handle your data with due security, confidentiality, care and respect. It is supported by staff training and other technical and organisational measures, including encryption and pseudonymisation.

In addition, if you are concerned your data is inaccurate, you may update it on the platform yourself or contact LiveUp in the first instance.
If you have a complaint regarding how your data has been handled by us, please first raise this with ADL Smartcare"s Data Protection Officer. If you are not satisfied with the outcome of this, you may escalate your complaint to the Office of the Australian Information Commissioner.
